Reel Unlimited's Terms of Service

1. Introduction and Service Description

Founded in 2021, Reel Unlimitedยฎ is a global design subscription service for agencies and startups operating across multiple regions including Ireland, Mexico, New Zealand, Australia, Hong Kong, Singapore, Spain, Germany, Switzerland, United Kingdom, Canada, Poland, France, South Africa, India, Nigeria, Italy, Portugal, and Brazil. We serve businesses with unlimited graphic design, video, motion graphics, UI/UX, and web development through dedicated designers, branded client portals, and unlimited revisions.

This Terms of Service document (“Agreement”) is established between Tarkle, Inc., doing business as Reel Unlimited (“we,” “us,” “our,” or “Reel Unlimited”) and you as the user. This Agreement outlines the rules and conditions for accessing and using our digital platforms across all regions and our subscription-based design services (“Services”).

Reel Unlimited operates through regional websites and platforms across all our service territories. By visiting our platforms or using our Services in any region, you confirm that you have reviewed, comprehended, and consent to follow this Agreement.

Our global operations are managed from our headquarters in Sheridan, Wyoming, United States, with regional teams across our service territories. You are responsible for following your local laws and regulations when accessing our Services.

We may update this Agreement from time to time. By continuing to use our platforms and Services after any updates, you accept the changes in their entirety. All updates are effective immediately upon posting.

2. Privacy Guidelines

Our privacy policy explains how we handle your personal data across all regions we serve. Your continued use of our platforms indicates acceptance of our Privacy Policy, which is part of this Agreement.

Users must be 18 years or older to use our Services. By using our platforms and Services, you confirm that you are of legal age to form a binding contract with Reel Unlimited and meet all eligibility requirements outlined in this Agreement. We maintain appropriate technical and organizational measures to protect your personal information in compliance with applicable regional data protection laws.

3. Communication Policy

Reel Unlimited responds to all customer inquiries within 1-2 business days during our standard business hours. Our support team operates across multiple time zones to serve our global customer base effectively.

Communication channels include:

  • Email support through our regional contact systems
  • Live chat during business hours Monday to Friday
  • Help center documentation available globally

We maintain professional communication standards and expect the same from our customers. See Section 15 for our respect and conduct policies.

4. Service Provisions and Access

4.1 Service Access: When you follow this Agreement and maintain an active subscription with paid fees, you can access our Services globally. We strive to keep our Services running smoothly across all regions, except during scheduled maintenance and unexpected technical issues.

4.2 Account Requirements: Your use of our Services must comply with this Agreement. You commit to provide true and complete account information, keep your account details current, maintain login credential security, report any unauthorized account access immediately, and take responsibility for all account activity.

4.3 Technical Requirements: You are responsible for having the necessary internet connection, devices, and technical setup to use our Services, including any related costs.

4.4 Account Termination Reel Unlimited may terminate your account without advance notice if we determine you have:

  • Broken this Agreement
  • Shared account access with unauthorized parties
  • Misused our services or treated our team inappropriately
  • Used services for unlawful purposes
  • Violated our respect and conduct policies (see Section 15)


4.5 Subscription End Policy
When your subscription ends for any reason, we immediately stop all work on your projects regardless of completion status or circumstances. It is your responsibility to manage project timelines and ensure adequate subscription time for project completion. We cannot provide any assistance or complete any work once your subscription has ended.

5. Pricing and Payment Policy

5.1 Pricing Structure: Reel Unlimited reserves the right to change service prices at any time without prior notice. Price changes apply to new subscriptions and renewals. Continuing to use our Services after a price change indicates your acceptance of the new rates.

Regional pricing is available in local currencies where applicable. All subscription plans are billed according to your selected billing frequency (monthly for regular plans, quarterly for agency plans).

5.2 One-Time Projects: One-time projects are available globally and will be billed at a minimum of $50 USD or local currency equivalent and a maximum of $75 USD or local currency equivalent per hour. Minimum purchase requirements and project scope limitations apply to all one-time work.

5.3 Payment Terms: All payments are due upon invoice receipt. By registering for our Services, you authorize Reel Unlimited to charge your chosen payment method based on your selected billing frequency. Overdue payments will incur monthly interest of 1.5% on unpaid balances, or the maximum rate allowed by local law, whichever is lower.

5.4 Payment Method Requirements: All subscription payments are primarily charged via credit card. However, for any reason, we may require the use of alternative payment solutions including bank deposit, ACH transfers, Wise, PayPal, or any other payment method we deem appropriate.

If we request that you change your payment method, you will have 30 days to provide and migrate to the new payment method. Failure to update your payment method within this timeframe may result in service suspension until payment method compliance is achieved.

We reserve the right to determine the most suitable payment method for your account based on geographic location, local regulations, or operational requirements.

6. Delivery and Project Management

6.1 Immediate Delivery Requirement: Clients must take delivery of completed work immediately upon notification. We do not guarantee availability of files or projects after initial delivery notification. It is your responsibility to download and secure all deliverables promptly.

6.2 Project Timeline Management:ย You are solely responsible for managing project timelines relative to your subscription period. We cannot guarantee project completion if insufficient subscription time remains. Plan your project submissions accordingly to ensure adequate time for completion and revisions.

6.3 Seven-Day Review Period: You have seven (7) days from file delivery to review and request necessary changes. We prioritize corrections reported during this review period. Change requests received after the seven-day window will be handled at our discretion based on available capacity.

7. Comprehensive No-Refund Policy

7.1 Strict No-Refund Policy: Reel Unlimited operates a strict no-refund policy for all services globally. Once payment is processed for any plan (Starter, Standard, Pro, or Agency White-Label), it cannot be refunded under any circumstances, regardless of local consumer protection laws where legally permissible.

7.2 Informed Purchase Acknowledgment: By making payment for Reel Unlimited services in any region, you explicitly acknowledge that you have:

  • Reviewed our service scope and concurrent project limits
  • Understood the difference between regular and white-label agency plans
  • Accepted that all sales are final with no refunds available
  • Made an informed purchasing decision


7.3 No Exceptions Policy:
There are no exceptions to this policy except where explicitly required by applicable law. In cases of duplicate charges due to technical errors, we will correct such errors promptly, but this does not constitute a refund.

8. Intellectual Property and Ownership Rights

8.1 Standard Ownership Transfer: Upon full payment of subscription fees, you retain exclusive ownership of all completed design work delivered during your active subscription period. This ownership transfer is contingent upon compliance with this Agreement and full payment of all fees.

8.2 Non-Payment and Chargeback Policy In cases of non-payment, chargebacks, or payment disputes:

  • All intellectual property rights immediately revert to Reel Unlimited
  • You forfeit all ownership claims to any work created during the disputed period
  • We retain the right to use, modify, or redistribute such work without restriction
  • No compensation will be provided for loss of work ownership


8.3 Chargeback Consequences:
Unauthorized chargebacks will result in:

  • Immediate and permanent loss of all work ownership rights
  • Permanent account ban from all Reel Unlimited services globally
  • Potential debt collection action across applicable jurisdictions
  • Legal action to recover costs and damages

9. Account Management and Data Retention

9.1 Account Deletion Policy: Accounts are automatically deleted 6 months after subscription cancellation. This includes:

  • Removal of all project files and data
  • Deletion of account access credentials
  • Permanent loss of all stored materials
  • No recovery options available after deletion


9.2 Data Backup Responsibility:
You are solely responsible for backing up and securing all important files before subscription cancellation. We recommend downloading all necessary materials well before your subscription end date.

10. Service Usage Guidelines

10.1 Project Scope and Volume: Your subscription plan determines project scope and volume limits. We accept design requests and revisions according to your plan terms, with delivery times varying based on request complexity and current workload.

10.2 Current concurrent project limits are as follows:

  • Starter Plan: 2 concurrent projects
  • Standard Plan: 3 concurrent projects
  • Pro Plan: 4 concurrent projects with specific allocation requirements
  • Agency Plans: Same limits with white-label features


Pro Plan Project Allocation:
The Pro plan’s 4 concurrent projects are specifically allocated as follows:

  • Up to 3 concurrent graphic design projects (including branding, social media, print design, etc.)
  • Up to 2 concurrent motion graphics/video editing projects
  • Exactly 1 concurrent website design project
  • Exactly 1 concurrent website development project


Important Website Project Restrictions:
Each Pro subscription supports exactly 1 concurrent website design project and 1 concurrent website development project. This allocation cannot be changed, modified, or adjusted under any circumstances or situations. You cannot have multiple website design projects or multiple website development projects running simultaneously, regardless of request volume or business needs.

Website Design vs. Development:

  • Website Design: UI/UX design, landing page design, website mockups, design systems
  • Website Development: Webflow development, WordPress development, Shopify development, coding implementation


These are separate categories and you may have one project from each category running concurrently, but never multiple projects within the same category.

Increasing Website Project Capacity: If you need more concurrent website design and development projects, you have two options:

  1. Additional Pro Subscriptions: Purchase additional Pro subscription seats at the price listed on our website. Each additional Pro subscription adds 1 more concurrent website design project and 1 more concurrent website development project.
  2. One-Time Projects: Purchase website projects on a one-time basis at our hourly billing rates ($50-75 USD per hour or local currency equivalent).

Policy Modification Rights: Reel Unlimited reserves the right to change, remove, or amend this policy at any time. We may increase or decrease the number of concurrent projects whenever we deem fit, and we have no obligation to inform anyone prior to such changes. These modifications may affect existing subscriptions and will be applied immediately upon implementation.

Exception: The website design and website development allocation limits for Pro plans are fixed and cannot be increased through policy changes. Additional website projects require additional Pro subscriptions or one-time project purchases.

10.3 Service Capacity and Project Scope: The productivity of your account correlates with your subscription level. Output capacity fluctuates according to plan specifications, concurrent request volume, and task complexity. We do not provide guarantees for specific output quantities per subscription.

10.4 Service Level and Turnaround Disclaimers: Reel Unlimited provides design subscription services optimized for small and short projects only. Our service is not designed or suitable for large, extensive projects requiring complex management structures or guaranteed delivery timelines.

Our service is designed to deliver projects between 2-7 business days depending on project type, size, and level of complexity. However, these are estimates only and do not constitute service level agreements (SLA) or guarantees.

  • Estimates are provided for planning purposes only


Clients requiring guaranteed delivery dates or complex project management should consider alternative service providers better suited for such requirements.

11. White-Label Services for Agencies

11.1 White-Label Service Overview: Reel Unlimited offers specialized white-label services for agencies across all regions, allowing agencies to serve their clients under their own brand while we provide design services in the background.

11.2 White-Label Features: Agency white-label services include:

  • Branded client portals with agency logo and domain
  • Custom domain setup (e.g., app.youragencyname.com)
  • Client communication under agency branding
  • Project management tools branded for agency use
  • File sharing through agency-branded systems
  • Complete invisibility of Reel Unlimited in client interactions


11.3 Agency Responsibilities:
Agencies using white-label services are responsible for:

  • Client relationship management and communication
  • Setting their own pricing and billing structures
  • Managing client expectations and project timelines
  • Providing first-level client support
  • Maintaining professional standards in client interactions


11.4 Reel Unlimited Responsibilities:
Under white-label arrangements, Reel Unlimited:

  • Delivers design work under agency branding
  • Maintains complete confidentiality regarding agency-client relationships
  • Provides technical support for white-label platform features
  • Ensures no direct contact with agency clients
  • Maintains professional standards in all branded communications


11.5 White-Label Billing and Terms:
White-label agency plans are billed quarterly with 3-month upfront payment requirements. All standard terms apply to white-label services, including the no-refund policy and project delivery timelines.

12. Non-Solicitation Policy

12.1 Comprehensive Non-Solicitation Agreement: By subscribing to Reel Unlimited services in any region, you explicitly agree to a comprehensive non-solicitation policy regarding our team members, staff, contractors, and affiliates.

12.2 Prohibited Activities: You agree not to, directly or indirectly:

  • Solicit, recruit, or attempt to hire any Reel Unlimited team member
  • Accept solicitation from any Reel Unlimited team member for outside work
  • Engage in employment discussions with our staff
  • Facilitate connections between our team members and third parties for employment
  • Encourage our team members to leave Reel Unlimited
  • Provide job opportunities or referrals to our team members


12.3 Time Restrictions:
This non-solicitation agreement applies during:

  • The sign-up and onboarding process
  • The entire duration of your active subscription
  • Four (4) years following the end of your subscription, regardless of reason for termination


12.4 Geographic Scope:
This non-solicitation policy applies globally across all regions where Reel Unlimited operates, including but not limited to Ireland, Mexico, New Zealand, Australia, Hong Kong, Singapore, Spain, Germany, Switzerland, United Kingdom, Canada, Poland, France, South Africa, India, Nigeria, Italy, Portugal, and Brazil.

12.5 Violations and Penalties: Violations of this non-solicitation policy will result in:

  • Immediate termination of services with no refund
  • Legal action to enforce the non-solicitation agreement
  • Monetary damages equal to 12 months of the affected team member’s compensation
  • Recovery of all legal fees and costs associated with enforcement
  • Permanent ban from all Reel Unlimited services globally


12.6 Team Member Protection:
Our team members are contractually obligated to report any solicitation attempts. This policy protects our business investment in training and developing our global team while ensuring service continuity for all clients.

13. Licensed Material Usage

13.1 Licensed Elements Permission: When you comply with this Agreement and pay all fees, we grant you limited permission to use Licensed Elements within your Created Work. This permission is non-transferable, revocable, worldwide, and royalty-free for single use within each Created Work only.

13.2 Usage Restrictions: You cannot use Licensed Elements separately, use the same Licensed Elements in other projects without new licenses, copy, sell, or modify Licensed Elements, or share Licensed Elements as standalone files.

13.3 Ownership Retention: Reel Unlimited and our partners retain ownership of all Licensed Elements, even when included in your Created Work. If you breach this Agreement, we can revoke your permission to use Licensed Elements, including those in existing Created Work.

14. Portfolio and Marketing Rights

14.1 Portfolio Usage Rights: Reel Unlimited reserves the right to share design work created for clients across our global digital channels, including social media, websites, portfolios, and marketing materials, unless restricted by executed Non-Disclosure Agreements.

14.2 Client Identification Rights: We may identify you as our customer and use your name and logo in our marketing materials globally unless you provide written notice with reasonable restrictions.

14.3 Review Collection and Publication Policy: Reel Unlimited automatically collects customer feedback and reviews at the completion of projects across all regions. By using our services, you explicitly agree that we may use your feedback and reviews publicly on our website, marketing materials, and promotional content.

Review Privacy Protection: To maintain appropriate privacy levels, we display only your first name (if applicable) alongside your review content. We do not publish full names, company details, or other identifying information unless separately agreed upon.

Review Usage Rights: Your reviews and feedback become the property of Reel Unlimited and may be used for:

  • Website testimonial sections
  • Marketing materials and advertisements
  • Social media content and campaigns
  • Sales presentations and proposals
  • Case studies and success stories


Consent and Waiver:
By submitting projects and using our services, you provide explicit consent for review collection and waive any claims to compensation for the use of your feedback in our marketing efforts. You acknowledge that reviews may be edited for length or clarity while maintaining the original meaning and sentiment.

This review collection and publication occurs automatically as part of our service delivery process across all global regions where we operate.

15. Partner Programs and Affiliates

Our referral programs operate globally through established third-party partners including Awin, Inc., Impact.com, and Partnero.com. Partner relationships are governed by separate agreements with each platform, and participants must comply with both Reel Unlimited’s terms and respective platform terms.

16. Technical Provisions and Service Interruptions

16.1 Service Availability: Reel Unlimited does not guarantee continuous platform availability globally. Service interruptions may occur due to hardware, software, or other issues beyond our control across any of our operating regions.

16.2 Electronic Communications: By using our Services, you consent to receive electronic communications from Reel Unlimited globally. You agree that all communications sent via email or through our platforms satisfy legal requirements for written communication in your jurisdiction.

17. Respect and Conduct Policy

17.1 Zero Tolerance Policy: Reel Unlimited maintains a zero tolerance policy for disrespectful or abusive behavior toward our staff across all global operations. The following behaviors will result in immediate account suspension with no refund:

  • Use of slurs, offensive language, or racially discriminatory terms
  • Abusive language or threatening communication
  • Harassment of any kind toward team members
  • Discriminatory behavior based on race, religion, gender, sexual orientation, age, disability, ancestry, or national origin


17.2 Immediate Consequences:
Violation of our respect and conduct policy results in:

  • Instant account suspension across all regions
  • Permanent ban from all Reel Unlimited services globally
  • Forfeiture of all work ownership rights
  • No refund of any payments made
  • Potential legal action where applicable

18. Force Majeure and Service Interruptions

18.1 Events Beyond Control: Reel Unlimited is not liable for failing to perform obligations due to events beyond our reasonable control across any operating region, including pandemics, government shutdowns, natural disasters, war, civil disorder, industrial disputes, telecommunications failures, utility disruptions, and cyber attacks.

18.2 Service Resumption: We will resume normal service operations promptly once circumstances beyond our control are resolved. No refunds or compensation will be provided for service interruptions due to force majeure events.

19. Legal Framework and Dispute Resolution

19.1 Governing Law These Terms of Service shall be governed by and interpreted according to the laws of the State of Wyoming, United States, without regard to conflict of law principles, regardless of the region from which you access our services.

19.2 Jurisdiction and Forum: Any legal action relating to these Terms shall be brought exclusively in the state courts of Sheridan County, Wyoming, or the United States District Court for the District of Wyoming.

19.3 Class Action Waiver: THE PARTIES AGREE TO BRING CLAIMS AGAINST EACH OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

19.4 Time Limitation: ANY CAUSE OF ACTION OR CLAIM MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION OCCURS.

20. Liability Limitations and Disclaimers

20.1 Limitation of Liability: Reel Unlimited’s total liability for any claims shall not exceed fifty dollars ($50.00 USD) or local currency equivalent, regardless of cause of action or region.

20.2 Warranty Disclaimers: ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” ACROSS ALL REGIONS. REEL UNLIMITED MAKES NO WARRANTIES AND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

20.3 Indemnification: You agree to defend, indemnify, and protect Reel Unlimited from claims arising from your use of our services, breaches of these Terms, or violations of third-party rights.

21. General Provisions

21.1 Entire Agreement: These Terms constitute the complete agreement between you and Reel Unlimited regarding our services across all regions.

By continuing to use Reel Unlimited services in any capacity, you acknowledge and accept these Terms of Service in their entirety. These terms can be modified at any time at our sole discretion without prior notice.

Universal Application: These Terms of Service apply equally to all users, whether you are:

  • A new client signing up for services

  • An existing client with an active subscription

  • A former client returning to use our services

  • A client accessing services across multiple regions


Ongoing Agreement:
Your continued use of Reel Unlimited services, platforms, or any related services constitutes your ongoing agreement to comply with these Terms of Service, including any modifications or updates we may implement.

Acceptance Through Use: Each time you access our platforms, submit a project, make a payment, or interact with our services in any way, you reaffirm your acceptance of these Terms of Service as they exist at that time.

Modification Authority: Reel Unlimited reserves the absolute right to modify, update, or change these Terms of Service at any time without prior notification to users. Your continued use of our services following any changes constitutes acceptance of the modified terms.

Final Acknowledgment: By using Reel Unlimited services in any region globally, you confirm that you have read, understood, and agree to be bound by these Terms of Service, and you acknowledge that these terms govern your relationship with Reel Unlimited regardless of your client status or history with our services.
